QuickServers Terms of Service

The use of services provided by QuickMeg Inc. on quickservers.net (hereafter “QuickServers,” “we,” “us,” or “our”) constitutes agreement to the following Terms and Conditions. By ordering, accessing, or using any QuickServers service, you (“Customer,” “Subscriber,” or “you”) agree to be bound by these Terms, including the Fee Schedule at the end of this document. If you do not agree, you must not use the Services.

1. General Terms

By using the Service, you agree to be bound by all of these Terms and Policies. If you are an individual Subscriber, these Terms apply to all persons who access the Service through your account. If you are a commercial Subscriber, these Terms apply to all of your employees, agents, and customers. A violation by anyone using your account is treated as a violation by you.

We reserve the right to refuse service to anyone. We may amend these Terms at any time by posting the revised version; your continued use of the Service after posting constitutes acceptance of the amended Terms.

All charges payable for the Services are as set out in the Fee Schedule and on the applicable product or order page, and are due and payable in accordance with the Billing section below. Fees are billed in advance except where usage-based or otherwise stated.

QuickServers is not responsible for any damages your business may suffer arising from use of the Services. Except as expressly stated, the Services are provided “as is” and “as available.”

2. Accounts, Eligibility, and Verification

To use the Services you must provide complete and accurate registration information, including a valid name, postal address, email, and, where applicable, payment details. Providing false or incomplete contact details is grounds for suspension or termination.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use.

QuickServers may perform additional verification on any order via telephone, SMS, or third-party fraud-detection systems, and may hold or decline an order pending verification.

3. Product-Specific Terms

The following sections set out terms specific to each product. All Services remain subject to the general Terms, Acceptable Use Policy, Billing, and Fee Schedule in this document.

3.1 Web Hosting (Shared, Semi-Dedicated & Reseller)

Shared, semi-dedicated, and reseller hosting are provided on a shared-server basis, with resources allotted per the plan purchased. Resources (CPU, memory, entry processes, I/O, storage, bandwidth) are limited to the amounts stated on the plan and by the physical limits of the environment.

  • Accounts must be used to serve web documents and directly related email/FTP, not as offsite file storage, backup service, or third-party mail/FTP provisioning.
  • File-quota limits apply (up to 300,000 files on Linux plans) to preserve system integrity.
  • If resource usage in QuickServers’ good-faith determination adversely affects other customers, we may require reduced usage or an upgrade to a higher plan or dedicated service.
  • Nightly backups of shared, semi-dedicated, and reseller servers are maintained for administrative purposes only and are not guaranteed. Customers are solely responsible for maintaining their own backups.

3.2 Virtual Private Servers (VPS)

NVMe KVM VPS instances are provided on QuickServers’ own network with the resources specified in the order.

  • If QuickServers in good faith believes resource usage (CPU, disk, or network) negatively affects normal operation, we may require an upgrade to a higher plan or dedicated server.
  • QuickServers does not back up VPS instances unless a backup add-on is purchased. Customers are responsible for their own backups.
  • Remote Offsite Backups are available as a paid add-on.

3.3 Windows VPS

Windows Server on NVMe KVM, provisioned and ready at boot.

  • Windows Server licensing is included in the plan fee unless otherwise stated.
  • Customer may not transfer, resell, or repurpose provided licenses outside the VPS on which they are issued.
  • Customer is responsible for in-guest configuration, updates, and security of the Windows environment.
  • The same resource-management and backup terms as Section 3.2 apply.

3.4 Dedicated Servers

Dedicated servers provide Dell bare-metal hardware allocated for Customer’s exclusive use, with full iDRAC access.

  • Hardware ownership: All server hardware, components, and peripheral equipment provided by QuickServers as part of a dedicated-server plan remain the sole and exclusive property of QuickServers. Customer acquires no ownership interest in QuickServers-provided hardware. (This section governs QuickServers-owned hardware only; customer-owned hardware placed in our facility is governed by Section 3.5, Colocation.)
  • QuickServers performs initial hardware setup and maintains the physical hardware; Customer is responsible for OS, software, configuration, updates, and security unless a managed add-on is purchased.
  • Failed hardware components are replaced at no additional cost except where damage results from Customer’s misuse.
  • QuickServers does not back up dedicated servers. Remote Offsite Backups are available as a paid add-on.
  • Remote Hands: Physical work performed on a dedicated server by QuickServers personnel at Customer’s request is billed at the Remote Hands rate in the Fee Schedule unless included in the order.

3.5 Colocation

Colocation provides physical space (1U to full rack) for customer-owned equipment, with A+B power, BGP-capable connectivity, and remote hands available.

  • Minimum term: Colocation is offered on a minimum 24-month term unless otherwise stated in writing. Early termination incurs an early-termination fee of no less than 100% of the remaining term of service.
  • Access: Only authorized QuickServers personnel may access QuickServers-controlled cabinets, cages, and equipment areas. Customer personnel and third parties may not enter QuickServers space or physically handle equipment in QuickServers-controlled areas except by prior written arrangement and under QuickServers supervision.
  • Remote Hands & physical work: Any physical handling of customer-owned equipment by QuickServers personnel — including installation, cabling, power-cycling, diagnostics, de-racking, removal, packing, and handoff — is a billable service at the Remote Hands and Equipment Removal rates in the Fee Schedule, unless included in the order.
  • Equipment removal / decommission: At end of service or on Customer request, removal and handoff of customer-owned equipment from QuickServers-controlled space is performed by QuickServers personnel as a billable service at the Equipment Removal / Handoff rate in the Fee Schedule. Customer is responsible for arranging retrieval within the timeframe QuickServers specifies.
  • Storage / space occupancy after termination: If customer-owned equipment remains in QuickServers-controlled space after the service term ends or after a scheduled removal, storage/space-occupancy charges apply at the rate in the Fee Schedule, per unit, per month, until the equipment is removed.
  • Abandonment: Equipment left in QuickServers-controlled space for more than ninety (90) days after termination, with charges unpaid and no arranged retrieval despite written notice to Customer’s contact of record, may be deemed abandoned and handled in accordance with applicable law.

3.6 Bulk IP Servers

Dedicated servers provisioned with large IPv4 allocations routed to the server.

  • IPv4 addresses are licensed, not sold, and remain the property of QuickServers or its providers. Customer’s right to use assigned IP space ceases on termination.
  • Customer must comply with ARIN and all applicable RIR policies, and must not engage in activity that leads to blacklisting or reputation damage of assigned space.
  • QuickServers may reclaim or re-assign IP space with reasonable notice for network-management or policy reasons.

3.7 Mac Mini Hosting

Physical Mac mini hardware, racked and made remotely available to Customer.

  • Mac mini hardware provided by QuickServers remains QuickServers’ property; Customer-owned Mac minis placed in our facility are governed by the Colocation terms (Section 3.5).
  • Customer is responsible for macOS configuration, updates, Apple ID/licensing, and compliance with Apple’s software license terms.
  • Remote Hands applies to physical work on the unit.

3.8 DDoS Protected VPS & DDoS Protected Dedicated

NVMe KVM VPS or bare-metal dedicated servers provided behind always-on DDoS mitigation.

  • QuickServers uses commercially reasonable, industry-standard mitigation but does not guarantee protection against all attacks, particularly novel or exceptionally large ones. No mitigation system is 100% effective.
  • Mitigation may, during an attack, affect some legitimate traffic; QuickServers is not liable for legitimate traffic affected by mitigation.
  • All other terms of the underlying VPS (3.2) or Dedicated (3.4) product apply.

3.9 Remote DDoS Protection (GRE)

Protection for servers on any network, delivered over a GRE tunnel.

  • Customer is responsible for maintaining the GRE tunnel configuration and the origin server; QuickServers is responsible for the scrubbing/mitigation layer only.
  • The no-guarantee and legitimate-traffic provisions of Section 3.8 apply.
  • QuickServers is not responsible for the availability, performance, or configuration of the third-party network on which the protected server resides.

4. Acceptable Use Policy

You agree not to use the Services in any manner that:

  • violates any applicable law, regulation, court order, or treaty (including intellectual-property, privacy, criminal, and international law);
  • sends unsolicited bulk email (“spam”) or hosts material advertised via spam from other networks;
  • stores or distributes pirated, nulled, cracked, or otherwise infringing software or media;
  • hosts prohibited services including open proxies, IRCD, autosurf, port scanners, banner-ad services, escrow, banking, investment, lottery, gambling, or pharmacy sites;
  • attempts to breach security, access accounts or data not belonging to you, or interfere with or deny service to any user or host;
  • engages in DoS/DDoS, mail-bombing, syn-flood, or unauthorized relay activity;
  • furnishes false sign-up or payment information; or
  • engages in harassment or the distribution of unlawful content.

Child sexual abuse material (CSAM) in any form is strictly prohibited and will be reported to law enforcement.

QuickServers maintains a zero-tolerance approach to spam. On notice of an alleged violation we will investigate within 48 hours and may restrict access during the investigation. Violations carry the Administrative Fees ($50 first violation; $100 and termination on a second) and Research Fees (up to $55 per hour of investigation time) set out in the Fee Schedule, and may result in suspension or termination. Suspected criminal activity will be reported to law enforcement.

5. Grounds for Suspension and Termination

QuickServers may suspend or terminate your account, with or without notice, on any violation of these Terms, including any AUP violation, non-payment, fraud, or activity that poses a security or operational risk.

  • Non-payment: Services associated with an overdue invoice may be suspended after 3 days and terminated with data removed after 7 days if the invoice remains unpaid, following reminders.
  • Chargebacks: Performing a chargeback on any transaction results in account suspension until resolved and the chargeback fee in the Fee Schedule. We reserve the right to remove the account and deny future business.
  • On termination or suspension, we may block and, after applicable retention periods, delete data. We may, at our discretion, retain data for a period to allow collection at Customer’s expense, subject to payment of outstanding amounts.
  • No bill credit is given for periods of suspension resulting from your violation.

6. Billing

  • Fees are set out on the applicable product page and in the Fee Schedule, and (other than usage-based fees) are billed in advance.
  • Renewal invoices are generated 15 days prior to the end of the current term and are due on the invoice due date.
  • Where a card is on file, we may attempt to charge it up to 2 days before the due date. It is your responsibility to keep a chargeable payment method on file.
  • Late fees: Once an invoice is overdue, a late fee of 10% (no less than $5) applies.
  • Overdue invoices may result in suspension (after 3 days) and termination with data removal (after 7 days).
  • If multiple invoices are overdue, all services in the account (and linked accounts) may be affected.
  • A reactivation fee (see Fee Schedule) applies to services restored after termination, where restoration is possible.

7. Cancellation Procedure

Cancellation requests must be submitted through the client area by opening a ticket with the Billing & Accounting department. No other form of cancellation is accepted.

  • Cancellations must be submitted before the next billing-cycle invoice is generated, or at least 7 days before renewal; otherwise the invoice is due.
  • Cancellation requests can only be submitted on an account with no outstanding invoices.
  • A late-cancellation fee (see Fee Schedule) applies to requests submitted after the cycle invoice has been raised.
  • It is your responsibility to cancel any PayPal or recurring card subscriptions you set up; QuickServers is not responsible for and will not refund excess funds paid.

8. Warranties and Liability

The Services and any software are provided on an “AS IS, AS AVAILABLE” basis. QUICKSERVERS MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. QuickServers does not warrant that the Services will be uninterrupted or error-free and does not guarantee the security or backup of your data.

You agree to indemnify and hold harmless QuickServers, its employees, and other customers from any claims, losses, costs, liabilities, damages, or expenses arising out of your use of the Services, your content, or your breach of these Terms.

To the maximum extent permitted by law, QuickServers’ liability to you is limited, and QuickServers is not liable for indirect, incidental, or consequential damages or loss of data.

9. Disputes and Governing Law

All billing disputes must be raised by opening a ticket with the billing department within 30 days of the payment date; otherwise the charge is deemed accepted.

Any dispute arising out of or relating to your subscription to or use of the Services that cannot be resolved informally between the parties shall be submitted by the aggrieved party to binding arbitration. The parties agree to first attempt informal resolution in writing before initiating arbitration. These Terms are governed by the laws of the State of Arizona, and venue for any dispute shall lie in Maricopa County, Arizona.

10. Fee Schedule

The following are QuickServers’ current standard rates. These rates are published as part of these Terms and apply in addition to the recurring fees shown on each product’s order page. QuickServers may update this schedule by posting a revised version; the rate in effect at the time a service is performed applies. All amounts are in U.S. dollars.

These Terms, including this Fee Schedule, constitute the agreement between you and QuickMeg Inc. (QuickServers) governing your use of the Services. By ordering or using the Services, you acknowledge that you have read, understood, and agree to be bound by them.
